By placing an order with Simply Trees, you agree to the following Terms of Service.

These terms govern the purchase and shipment of all products sold through simplytrees.com.

Product Guarantee

At Simply Trees, we take great care to ensure every plant we ship arrives healthy and ready to thrive. Because plants are living organisms and experience natural stress during shipping and transplanting, minor cosmetic imperfections such as leaf drop, bent stems, or seasonal dormancy are considered normal and do not indicate plant failure.

Arrival Issues (First 5 Days)

If your plant arrives significantly damaged or in poor condition, please contact us within five (5) days of delivery so our team can review the situation.

We may request clear photos of:

  • the plant
  • the packaging
  • the shipping label

to determine the appropriate resolution.

If an issue is confirmed, Simply Trees may provide replacement or store credit at our discretion.

1-Year Plant Guarantee

Simply Trees offers a 1-Year Guarantee on eligible plants.

If a plant fails to survive within *one year of delivery, customers may submit a guarantee request for review.

Approved claims will receive one replacement of the same plant variety and size.

Replacement is the sole remedy provided under the Simply Trees 1-Year Guarantee.

If the original plant is no longer available, Simply Trees may issue store credit equal to the original purchase price paid, including any discounts applied at the time of purchase.

Customers are responsible for shipping fees ($19.95) and applicable taxes on replacement orders.

This guarantee does not apply to:

  • improper planting
  • over- or under-watering
  • neglect or incorrect care
  • planting outside USDA recommended zones
  • poor indoor conditions
  • extreme weather events
  • winter desiccation / damage due to cold
  • heat stress, leaf scorch, or sunburn / damage due to heat
  • animal damage
  • disease introduced after planting
  • cosmetic stress from shipping or transplanting
  • plants that have already received a replacement

Claims must include photos and a brief care summary.

*The Simply Trees 1-Year Guarantee applies only to orders placed on or after July 24, 2025. Orders placed prior to this date remain covered under our previous 30-day guarantee policy.

 

Dormant Season Considerations

Deciduous trees or shrubs purchased between October 15 and early spring may arrive dormant and may not leaf out immediately.

Customers who believe a dormant tree or shrub has failed to emerge from dormancy should contact Simply Trees no later than June 15 so our horticulture team can review the claim.

Guarantee Effective Date

The Simply Trees 1-Year Guarantee applies only to orders placed on or after July 24, 2025.

Orders placed before this date remain covered under our previous 30-day guarantee policy.

Shipping

Orders typically ship within 1–5 business days after purchase.

Transit time generally ranges 3–4 business days depending on destination.

Delivery timelines are estimates only and are not guaranteed.

Simply Trees is not responsible for delays caused by:

  • carriers
  • weather events
  • natural disasters
  • local disruptions
  • seasonal volume

Orders are not processed or shipped on weekends or U.S. holidays.

To protect plant health, Simply Trees may temporarily delay shipments during extreme weather conditions.

Once an order has shipped, we are unable to modify, cancel, or reroute the shipment.

Scheduled Ship Dates

Customers may select a Scheduled Ship Date at checkout.

This feature allows customers to request that their order ship from our Texas facility at a later date rather than shipping immediately.

The selected date represents the estimated date the order will leave our facility, not the delivery date.

Scheduled shipments operate within an approximate two-day shipping window.

Example:

Selecting March 25 means the order is expected to ship between March 25 and March 27.

Delivery timing will vary depending on:

  • carrier transit times
  • destination
  • weather conditions
  • operational volume

Selecting a scheduled ship date does not guarantee delivery on or by a specific date.

If an order has not yet entered fulfillment, customers may contact our team to request a delayed ship date.

Once an order has been packed, fulfilled, or transferred to the carrier, shipment dates cannot be modified.

Simply Trees is not responsible for carrier delays once a package leaves our facility.

Delivery Issues

For orders with Shipping Protection:

If you added Shipping Protection to your order, file a claim at:

covrly.claimsorted.com/submit-a-claim

You’ll need your order number and a description of what happened. Our team will review it and, if approved, arrange a replacement, store credit, or refund.

For orders without Shipping Protection:

Shipping Protection is optional and may be added at checkout. Orders placed without Shipping Protection will ship without Shipping Protection coverage.

In the event of a shipping issue for an order placed without Shipping Protection, the following policies apply:

Packages Damaged During Transit

If a package arrives with severe visible damage, customers should refuse delivery so the package can be returned to Simply Trees. If a package is accepted and damage is discovered afterward, customers must notify Simply Trees within five (5) days of the delivery date.

Simply Trees reserves the right to request photos of the product and packaging in order to evaluate shipping damage claims.

Lost in Transit (Carrier Error)

If a package is confirmed lost in transit by the shipping carrier, Simply Trees may investigate the shipment with the carrier. If the carrier confirms that the package cannot be located, Simply Trees will provide a replacement for the affected items. Refunds are not guaranteed for orders without Shipping Protection.

Incorrect Shipping Address Provided at Checkout

Customers are responsible for providing a complete and accurate shipping address at checkout. If an order is lost, delayed, or delivered to an incorrect location due to an address error provided by the customer, Simply Trees cannot issue a refund or replacement.

Packages Marked Delivered but Missing (Possible Theft)

If a package is marked as delivered by the carrier but cannot be located, customers should first check the surrounding delivery area and with neighbors. Customers may also be required to file a claim directly with the shipping carrier. Once a package is marked as delivered by the carrier, Simply Trees is not responsible for theft or loss occurring after delivery.

Simply Trees may review certain cases at its sole discretion and determine whether additional assistance is appropriate.


Refused Deliveries

Refused shipments of live plants are not eligible for refunds.

Because plants are perishable, refusal of delivery often results in plant death.

Customers remain responsible for the full purchase price.

Orders refused due to incorrect addresses or delivery issues caused by the customer are also not eligible for refunds.

Carrier Holds & Customer Pickup Responsibility

If a customer requests that a shipment be held at a carrier facility, the customer is responsible for retrieving the package promptly.

Packages not picked up within 24 hours of arrival at the hold location are no longer eligible for the Simply Trees guarantee.

If the shipment is returned to sender due to failure to retrieve the package, Simply Trees is not responsible for plant condition and is not liable for replacement, refund, or reshipping.

Returns

Due to the living nature of plants, Simply Trees does not accept returns or exchanges on plant material.

Customers are encouraged to plant, compost, or gift plants rather than attempting to return them.

Order Cancellations

Customers may request order cancellations or changes within two (2) hours of placing an order.

After this window, our team may have already begun selecting and preparing plants.

Cancellations requested after the two-hour window may be subject to a 25% restocking fee.

Once an order has shipped, it cannot be canceled or modified.

Plant Expectations

Plants are living organisms and may vary in appearance depending on:

  • season
  • weather
  • growing conditions
  • pruning practices
  • dormancy cycles

Leaf drop, discoloration, or slower growth after shipping are normal parts of transplant adjustment.

Dormancy

Many plants enter dormancy during fall and winter.

Dormant plants may arrive with:

  • fewer leaves
  • discoloration
  • complete leaf drop

This is normal and beneficial for transplant success.

Dormant plants should be given adequate time to resume growth before claims are submitted.

Plant Sizing & Growth Rates

Plant size, growth rate, flowering, and fruit production depend on environmental conditions and care.

Sizes listed on product pages are approximate ranges and may vary slightly depending on the time of year.

Plants may arrive a few inches shorter than the listed height, which is normal for living plants.

Simply Trees does not offer refunds or replacements for minor size variations when plants arrive healthy.

Tree Height Measurement Policy

Tree height measurements are taken from the top of the rootball unless otherwise noted.

For rose trees, house plants, fruit trees, citrus trees, and olive trees, height is measured from the base of the pot.

Measurements must be taken before planting.

Post-planting measurements are not valid because planting depth and soil settling can affect perceived height.

Pot Sizes Explained

Plant container sizes follow the nursery trade gallon standard, which differs from traditional liquid gallon measurements.

Before shipping, plants may be:

  • pruned
  • tidied
  • burlapped

These practices support plant health during transit.

Image Representation

Images displayed on our website often depict mature specimens.

Plants shipped to customers are typically younger plants that will grow into the mature appearance shown in photos.

Actual plants may differ in size, shape, and fullness at the time of delivery.

Regional Shipping Restrictions

Certain fruit and citrus trees cannot be shipped to specific states due to USDA or state agricultural restrictions.

If an order cannot be shipped to a customer’s location, Simply Trees will issue store credit equal to the purchase price.

Discounts & Promotions

Only one discount code may be used per order.

Discount codes:

  • cannot be combined with other promotions
  • must be applied at checkout
  • cannot be applied after purchase

Simply Trees reserves the right to modify or cancel promotions at any time.

Pricing errors may be corrected at any time, including after an order has been submitted.

Limitation of Liability

To the fullest extent permitted by law, Simply Trees shall not be liable for any indirect, incidental, or consequential damages arising from the purchase or use of our products, including but not limited to landscaping loss, property damage, lost profits, or replacement landscaping costs.

In all circumstances, Simply Trees’ liability shall not exceed the amount paid for the product in question.

Governing Law

These Terms of Service shall be governed by and interpreted in accordance with the laws of the State of Texas.

Any disputes arising from purchases made through Simply Trees shall be resolved exclusively in courts located within the State of Texas.

Accessibility

Simply Trees is committed to maintaining an accessible website in accordance with the Americans with Disabilities Act.

Mobile Terms of Service

The Simply Trees mobile message service (the "Service") is operated by Simply Trees (“Simply Trees”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Simply Trees’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Simply Trees through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Simply Trees. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18445430691 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Simply Trees mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
